1. Acceptance of Terms
By accessing or using Flexxistay ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, discontinue use immediately. These Terms form a legally binding agreement between you and Flexxistay for all browsing, booking and post‑stay interactions.
2. Eligibility
You must be at least 18 years old and legally capable of entering contracts. Providing false identity details or booking on behalf of another person without consent is prohibited.
3. Accounts & Authentication
Some features may require an account. You are responsible for maintaining confidentiality of login credentials and all activities under your account. Notify us promptly of any unauthorized access.
- Do not share passwords publicly.
- Use a strong password and change periodically.
- We reserve the right to suspend compromised accounts.
4. Bookings & Payment
All bookings are subject to availability and successful confirmation. Pricing displayed includes applicable taxes unless otherwise stated. Payment methods: cash at property, UPI, credit/debit cards (processed by secure third‑party gateways). A booking is confirmed only after you receive a confirmation ID.
Incorrect pricing due to technical errors may be adjusted; you will be notified with option to cancel without charge.
5. Cancellation & Refunds
Cancellations are governed by our dedicated Cancellation Policy. Free cancellation typically applies up to 2 hours before scheduled check‑in. No‑show or late cancellation may incur charges equivalent to one hour or the first slab. Refunds (if applicable) are processed within 5–10 working days depending on payment channel.
6. Guest Conduct
While on property, guests must adhere to hotel‑specific rules posted at reception plus Platform guidelines:
- No unlawful activities or misuse of property.
- No damage or removal of hotel assets.
- Respect privacy and comfort of other guests; avoid excessive noise.
- Follow local regulatory requirements (valid ID, age restrictions).
Violations may result in immediate eviction without refund and potential legal action.
7. Prohibited Uses
You agree NOT to:
- Exploit the Platform for spamming, scraping, automated data harvesting.
- Attempt unauthorized access, reverse engineer or bypass security controls.
- Use false identities or attempt identity impersonation.
- Upload malicious code or compromise availability.
8. Intellectual Property
All logos, branding, design elements, text content and compiled data are exclusive property of Flexxistay or its licensors. Limited, revocable license granted for personal, non‑commercial use of the site. Unauthorized reproduction, adaptation, redistribution, or creation of derivative works is prohibited.
9. Privacy
Your data usage is described in our Privacy Policy. These Terms incorporate that policy by reference. In case of conflict, explicit consent or legal requirement prevails.
10. Liability & Disclaimers
We strive for accurate availability, pricing, and descriptions. However, occasional discrepancies may occur due to third‑party updates or latency. To the extent permitted by law, Flexxistay is not liable for indirect, incidental, or consequential damages arising from Platform use.
- Force Majeure: We are not responsible for failures caused by events beyond reasonable control (natural disasters, cyber attacks, regulatory changes).
- Property Services: Individual hotels are responsible for onsite execution of promised amenities; we facilitate discovery and booking.
11. Indemnification
You agree to indemnify and hold harmless Flexxistay, its directors, employees and partners from claims arising out of your misuse of the Platform, breach of these Terms, or violation of any law or third‑party rights.
12. Modifications & Suspension
We may modify features or suspend access (temporarily or permanently) for maintenance, security or strategic reasons. Material changes to Terms will be signposted; continued usage constitutes acceptance.
13. Termination
We may terminate or restrict your account if you violate laws, misuse the Platform, or endanger other users. Upon termination, all rights granted under these Terms cease immediately.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Disputes should first be attempted to be resolved amicably via support escalation. Failing that, jurisdiction lies with competent courts in Mumbai.
